| Appeals Court Upholds Arcadia Bluffs Golf Course Ruling | Thu. Aug. 26 2004 |
| The Michigan Court of Appeals has upheld a ruling made by a Manistee County Circuit Court jury that a Charlevoix contractor was not liable for a washout at the Arcadia Bluffs Golf Course. In 2001, a jury ruled that the contractor was not responsible for the effects of rainstorms in 1998 and 1999 that washed tons of contaminated soil into Lake Michigan. The ruling by the Appeals Court means the owner of the course, Richard Postma, must pay the contractor more than $500-thousand in damages. Last year, Postma agreed to pay $125-thousand to settle a suit filed by the Department of Environmental Quality related to the soil washout. |
